The following statutory warranty provisions form the basis of the warranty concluded with the consumer (non-professional end user).

Precisions

• The seller guarantees that the bicycle corresponds to the order and complies with the Belgian legislation on product safety and the most recent state of the art. • Visible defects of which the buyer was aware or could have been aware of the existence at the time of delivery are, in the absence of protest by the buyer, considered to have been accepted by the mere fact of delivery.

The following statutory warranty provisions form the basis of the warranty concluded with the consumer (non-professional end user).

Warranty duration

• It is expressly agreed between the parties that, subject to a written statement on the front of the order form giving a longer warranty period to the buyer for the whole or parts of the bicycle, the intervention of the seller with regard to the warranty is determined at 24 months from delivery.

Content scope

• For any defect other than visible defects, the repair or replacement of the bicycle is covered by the following guarantee: the buyer has the right to demand from the seller the repair of the bicycle, unless such repair would be technically impossible or would prove disproportionate to the value of the bicycle and in the interest of the defect. In that case, the buyer can demand an appropriate price reduction or the rescission of the sale if he cannot obtain the repair or replacement of the bicycle. This also applies if the seller has not carried out the repair or replacement within a reasonable period of time or without serious disadvantage for the buyer. Any refund of the price to the buyer will be reduced by an amount equal to the depreciation due to use.

• Any use that manifests itself within the first six months of delivery, unless proven otherwise by the seller, is deemed to have already existed at the time of delivery.

• After the expiry of this initial period of six months, the buyer retains his rights to the same guarantee if he can prove that the defects that appeared before the expiry of the guarantee already existed at the time of delivery.

• Under no circumstances will the buyer be able to demand dissolution of the agreement if the defect he invokes is minor.

• Any repairs will be made within a reasonable time and without any disadvantage for the buyer.

• When using suspension forks, the manufacturer's instructions must be strictly followed and the relevant warranty provisions will apply.

• Work carried out under guarantee must be carried out in the workshop of the seller or in a workshop designated by him. Subject to the prior written consent of the seller, the buyer may have the repair carried out in another workshop.

• The warranty does not cover maintenance, adjustments, tightening and other preparations necessary for normal use of the bicycle, nor parts and components that are normally replaced during maintenance. The warranty does not cover normal wear and tear of the bicycle (e.g. tyres, chain, cables and brake pads). The warranty cannot be invoked by the buyer if the defect is due to abnormal use of the bicycle, negligence or damage due to a traffic accident or fall, to a defect or poor maintenance by the buyer, nor if the bicycle has been has been rebuilt or used - subject to express specifications on the order form by the buyer and accepted by the seller - in competition. The bicycle that underwent repairs or assembly at a non-specialist dealer or of which repairs or assembly of parts was done with parts not originally intended for this purpose or technically incompatible, is also not covered by the warranty. Likewise for bicycles used for rental.

• The seller's guarantee intervention depends on the use of the bicycle with due diligence and respect for the manufacturer's instructions for use.

• The repairs are under warranty at least during the still running warranty period of the bicycle. This warranty covers both the work performed and the replaced parts, unless supplied by the purchaser.

• The buyer who wishes to invoke the guarantee must notify the seller in writing within the shortest possible time from the moment the buyer discovers the defects or should have discovered them.

• The purchaser undertakes to take the necessary steps not to aggravate the damage by not using the bicycle. In the event of default, the aggravation will be taken into account to determine the degree of intervention by the seller.

• The seller's liability for damage caused by a defect in the sold bicycle (physical injuries or damage to other goods) is governed by general law.

• The costs of transporting the bicycle and/or parts to and from the dealer are the responsibility of the owner
